II. Scope

This Policy applies to all incoming, continuing and transfer student-athletes in the UIS athletics program.

 

III. Purpose

The purpose of this policy is to implement the NCAA Board of Governors Policy on Campus Sexual Violence as amended. In summary, the NCAA Policy requires institutions to determine whether student-athletes have been disciplined through a Sexual Misconduct proceeding or criminally convicted of sexual, interpersonal or other acts of violence, to share relevant disciplinary information, and to adopt written procedures that direct staff to gather such documentation. IV. Statement of Policy

Incoming, continuing and transfer student-athletes are required to complete an annual disclosure as to whether past conduct has resulted in an unresolved adjudication and/or discipline through a Sexual Misconduct proceeding or in a criminal conviction for sexual, interpersonal, or other acts of violence. Failure to make a full and accurate disclosure may result in discipline, up to and including dismissal.

The University Dean of Students and the Title IX Coordinator, consistent with federal and state law, are authorized to share relevant disciplinary and Title IX information with officials of NCAA member institutions of postsecondary education where the student-athlete is enrolled, seeks to enroll or intends to enroll, including incomplete Title IX proceedings.

 

V. Procedures

A. Disclosure and Information Gathering: The Department of Athletics ("Athletics") is responsible for distributing pre-season NCAA paperwork to student-athletes that includes the annual disclosure required by this Policy. In the event a disclosure is made by an incoming student-athlete or transfer student-athlete, Athletics is responsible for instructing the student-athlete on the information needed to evaluate the matter and where to direct the information. The Dean of Students shall gather information that reasonably yields information from a student-athlete's prior institution(s) regarding whether or not the student left a prior institution with an incomplete Title IX proceeding, was disciplined through a Title IX proceeding, or has a criminal conviction for sexual, interpersonal or other acts of violence.

B. Evaluation Process: The Evaluation Process and Criteria and the Appeal process in place for implementation of the University of Illinois Policy for Consideration on Criminal History in Undergraduate Admissions shall be applied for review of sexual misconduct histories required by this Policy, except

a. Recommendations will be made to the Assoc. Vice Chancellor for Enrollment, Online, Professional and Engaged Learning.

b. Potential outcomes may be: 

i. The student-athlete has successfully completed the sexual misconduct review process and is authorized to participate in the athletics program;

ii. The student-athlete must comply with certain conditions (which will be enumerated) as a result of the sexual misconduct review in order to participate in the athletics program; or

iii. The student-athlete is not eligible to participate in the athletics program at UIS.

c. Appeals may be submitted to the Vice Chancellor for Student Affairs within ten (10) calendar days of receipt of the outcome. The appeal outcome shall be communicated in writing and shall be final.

C. Requests for Disclosures from NCAA Member Institutions: Any requests for disclosures from other NCAA Member Institutions shall be directed to the Dean of Students or the Title IX Coordinator for handling.
