Eligibility for ODS Services
In conformance with Section 504 of the Rehabilitation Act of 1973 and
the Americans with Disabilities Act of 1990, a person has a disability
if he/she has:
-
a physical or mental impairment which substantially limits one or
more of such a person's major life activities;
-
has a record of such an impairment, or
-
is regarded as having such an impairment.
"Substantially limits" refers to:
(A) a person unable to perform a major life activity that the average
person in the general population can perform; or
(B) a person significantly restricted as to the condition, manner,
or duration under
which the average person in the general population can perform
the same major life activity. The disability can be permanent such
as vision or hearing loss, mobility impairments, or a chronic
health condition. A temporary
disability, such as serious illness, surgery, injury or other condition
that impedes
a person's activities for more than one week, also meets the definition
requirement for services.
